5. User Content and License

You retain all ownership rights to the content you submit, post, or display on the Platform ("User Content"). However, by submitting User Content, you grant QKKIE a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Platform.

You represent and warrant that your User Content:

• Does not violate any applicable laws or regulations
• Is accurate and not misleading
• Does not contain viruses or malicious code

The QKKIE name, logo, and all related names, logos, and designs are trademarks of QKKIE. You may not use these trademarks without prior written permission.

6.3 Copyright Complaints

• Identification of the copyrighted work claimed to have been infringed
• Identification of the allegedly infringing material
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement under penalty of perjury that the information is accurate

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

8. Account Termination and Suspension

9. Disclaimers and Limitations

9.1 Service "As Is"

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

9.2 No Guarantee of Results

QKKIE does not guarantee that you will find a match, develop a relationship, or achieve any particular results through the Platform. We are not responsible for the conduct of any user on or off the Platform.

9.3 Third-Party Content

The Platform may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

10. Limitation of Liability

To the maximum extent permitted by law, QKKIE and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or relating to your use of the Platform.

In no event shall our total liability to you for all claims exceed the amount you have paid to us, if any, in the last six months, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless QKKIE and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Platform
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property rights
• Any claim that your User Content caused damage to a third party

12. Dispute Resolution

12.1 Informal Resolution

Before filing any claim against QKKIE, you agree to attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 60 days.

12.2 Binding Arbitration

If the dispute cannot be resolved informally, you agree to resolve any claim through final and binding arbitration, except as set forth below. The arbitration will be conducted by a single arbitrator under the rules of the American Arbitration Association.

12.3 Exceptions

Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Platform, or for intellectual property infringement.

12.4 No Class Actions

You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class or representative action.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Platform or by email at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the modified Terms.

The "Last Updated" date at the beginning of these Terms indicates when they were last revised.

14. Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
